How to Work With a Tax Attorney If You Have Issues With Tax Debt

One of the IRS’s most potent weapons can be directly neutralized when you hire a tax attorney, CPA, or tax relief firm. The failure to understand IRS tax and collection law is that weapon. However, such ignorance is fully addressed in my eBook on tax relief. Many people work with a tax expert to avoid dealing with irritable IRS employees directly. When I hired tax lawyers, I believed representing our client’s interests when dealing with the IRS was our most excellent service.

Although it would be nice to avoid speaking with an IRS agent, is it worth $3,000 to $10,000?

The average time spent speaking on the phone with an IRS agent is under an hour. This is true whether you are the top attorney in the United States or just a regular guy with no legal background. It is up to you to decide whether or not that hour was painful enough for you to want to spend the kind of money tax lawyers demand.

Tax Debtors Rarely Have Plenty of Cash

The extent of your financial resources will play a significant role in your choice to hire a tax attorney. You must evaluate whether hiring a tax professional wisely uses your limited financial resources. Naturally, the response to this query depends on the “story” you hear from the individual attempting to solicit your business. You will receive a story in good faith if you speak with a significant tax firm. There is a reason why a written assurance might not back those clear skies of tax forgiveness. You might not have spoken with a tax lawyer but instead a “tax professional” or “tax consultant.” A tax professional has a commission to earn, whereas a tax attorney has years of training and a bar license to defend.

They all boast of significant successes but never provide you with a written guarantee.

For two reasons, an honest tax attorney rarely provides a written guarantee. First of all, lawyers dislike issuing refunds. As a result, it is much more likely that any papers the lawyer signs are unclear. Any written pledges must only promise that the IRS will mistreat you, that they’ll carry out their end of the bargain, and that they’ll “try” very hard. Second, a tax attorney must maintain good standing to retain his or her bar license, and breaking commitments is a surefire way to lose that standing. Why are these folks unable to keep their word? Because the IRS has the final say, and if the IRS says no, it’s a no.

A Licensed Tax Attorney is Unlikely to Provide Any Written Guarantee.

One of my favorite strategies tax relief companies employ is to caution you to be wary of any business that offers a warranty on its work. Right, doesn’t that sound suspicious? Any business that guarantees its work is typically untrustworthy. A company with a guarantee has more credibility than one without one. Why should you feel happy if they aren’t optimistic about their ability to assist you and can’t provide a guarantee for their work?

That hourly rate for a phone call without a guarantee is beginning to seem incredibly expensive, as it should. You may want to reconsider performing the task yourself if you pay $3,000 (or more) for an hour of telephone labor. However, there is some good news if you cannot negotiate with the IRS alone.

You can ask for a time-out and bring in a tax attorney at any point during IRS negotiations.

Consider that. Simply retain legal counsel if you realize you are in over your head now. I believe it is worthwhile to attempt.

How Generally do Tax Relief Representation Services Operate

Once you have hired a tax relief company, they will deal with the IRS on your behalf. You still need to put in some independent work, though. A questionnaire form with at least ten pages will be delivered to you. They can have up to 30 pages, as I’ve observed. Before an attorney starts addressing your IRS issue, you must answer all the questions. You mail the questionnaires to your tax attorney after completing them. After receiving your responses, a data entry clerk will enter them into the computerized IRS forms.

A letter will be issued to you asking additional questions or requesting clarification if the attorney has any concerns about your responses or requires more information. The new or amended information is entered into their computers after you have mailed the additional information. At this point, your IRS forms are typically printed after a tax lawyer has reviewed the data submitted by the data entry department. Now the IRS forms are mailed to you along with a list of the supporting documents you must copy and submit to the IRS, which is often several pages long. After that, you mail the completed IRS forms and supporting paperwork to the IRS.

Sounds Like You Completed the Work of the Tax Attorney. Okay, so you did.

In all honesty, the lawyer would undertake any necessary phone work on your behalf. But as you can see, there’s a good reason why you have to pay everything upfront. You answer the questions on the forms. You receive the paperwork. The IRS paperwork is completed, signed, and then mailed. The IRS typically responds by mail and accepts your case. The Tax Attorney then calls you with excellent news and claims credit for being an effective negotiation.

You can complete the IRS forms independently, and you should still provide the information.

A more knowledgeable somebody (perhaps a lawyer) will study those forms for at least five minutes.

You must gather supporting documentation, such as pay stubs, copies of your bills, rental agreements, etc., to prove the information on the forms.
All of this material must be mailed to the IRS or returned to the tax relief company, which will then forward the package to the IRS.
The IRS often responds to tax relief requests via mail.
An attorney may speak with the IRS for up to an hour. However, that would be roughly 45 minutes longer than is often necessary.
The lawyer sends you a letter outlining the conditions of your agreement after receiving the letter accepting your request for tax relief.
A ” professional ” will receive a substantial commission check in tax relief.
You will have done most of the work, but the lawyer will receive most of the credit if the case succeeds, even though they may have spent only five minutes on it.
As you can see, the procedure requires you to give the tax relief lawyer or his company all your financial details. You compile the necessary financial documentation to demonstrate your eligibility for the suggested tax reduction, review the forms, sign the documents, and mail them.
